Data processing agreement (DPA)
Data processing agreement (Art. 9 FADP) under which Vergasta Digital processes, on behalf of the shop, the data of its customers.
Last updated: October 22, 2026
This agreement (the "DPA") supplements the terms and conditions. It applies when Vergasta Digital processes personal data on behalf of a shop that uses Avis Boost.
Parties
- The controller is the business using Avis Boost (the "shop").
- The processor is Vergasta Digital, Rue du Temple 5, 2610 Saint-Imier, Switzerland, contact@avisboost.ch.
Subject and duration
The processor processes the data only to provide Avis Boost to the shop: sending review requests and reminders, the rating page, receiving and displaying private messages. Processing lasts as long as the shop’s account is active.
Categories of data and data subjects
| Category | Data subjects |
|---|---|
| First name, last name, mobile number, e-mail, language | Customers of the shop |
| Request history and text message delivery status | Customers of the shop |
| Ratings, private messages and their handling | Customers of the shop |
Processor obligations
- Process the data only on the shop’s instructions, given through its use of the service.
- Ensure the confidentiality of the people authorised to access it.
- Implement appropriate technical and organisational measures (Art. 8 FADP).
- Help the shop answer requests from data subjects (Art. 25 to 29 FADP).
- Notify the shop as soon as possible of any data security breach (Art. 24 FADP).
- Delete the data at the end of the agreement, or at the shop’s request.
Shop obligations
The shop has a legal basis to contact its customers, informs them of the processing, and respects their requests to stop or to delete their data.
Sub-processors (Art. 7 DPO)
The shop authorises the use of the following sub-processors for the data of its customers.
| Sub-processor | Activity | Location |
|---|---|---|
| Infomaniak Network SA | Application and database hosting, sending e-mails | Switzerland |
| Twilio Inc. | Sending text messages | United States / international |
If a sub-processor is added or replaced, the processor informs the shop by e-mail at least 30 days in advance. The shop may object in writing within that period. If the objection cannot be resolved, it may cancel its subscription free of charge and export its data.
Transfers abroad
Transfers to sub-processors outside Switzerland are limited to the data needed and covered by appropriate safeguards (Art. 16 and 17 FADP).
End of the agreement
When closing its account, the shop can export its data. The processor then deletes the data of its customers within a reasonable time, unless the law requires it to be kept.
Acceptance
By creating an Avis Boost account, the shop accepts this DPA.
